PHILADELPHIA BAR ASSOCIATION RESOLUTION URGING ADHERENCE TO THE RATINGS OF JUDICIAL NOMINEES BY THE AMERICAN BAR ASSOCIATION STANDING COMMITTEE ON THE FEDERAL JUDICIARY

WHEREAS, the Philadelphia Bar Association has a long history of support and advocacy for a high quality judiciary; and

WHEREAS, the Philadelphia Bar Association’s Commission on Judicial Selection and Retention has been conducting independent, thorough and impartial evaluations of the professional qualifications of candidates for judicial office in Philadelphia for more than forty years; and

WHEREAS, the American Bar Association’s Standing Committee on the Federal Judiciary (the “Committee”) has similarly been conducting independent, thorough and impartial evaluations of the professional qualifications of nominees to the federal bench since 1953; and

WHEREAS, the members of the Committee are lawyers of the highest professional stature and integrity with varied professional experiences and backgrounds, well-suited to evaluate the professional qualifications of their peers; and

WHEREAS, the Committee evaluates each judicial nominee on the basis of three criteria: integrity, professional competence and judicial temperament; and

WHEREAS, the Committee does not consider a judicial nominee’s philosophy, political affiliation or ideology; and

WHEREAS, based on its investigation and application of the three criteria, the Committee rates judicial nominees as “Well Qualified,” “Qualified” or “Not Qualified” for judicial office; and

WHEREAS, the Committee transmits its rating to the nominee, the Senate Judiciary Committee, the White House and the Department of Justice; and

WHEREAS, the Committee’s evaluation of judicial nominees have helped to maintain and enhance the high quality of the federal judiciary,

NOW, THEREFORE, BE IT RESOLVED that the Philadelphia Bar Association urges the President, the Senate Judiciary Committee and all members of the Senate to adhere to the ratings of the American Bar Association’s Standing Committee on the Federal Judiciary, and to reject for confirmation any judicial nominee found “Not Qualified,”

AND BE IT FURTHER RESOLVED that the Chancellor and his or her designee shall take all necessary steps to effectuate the contents of the resolution.
