Trial as Teaching: How to Make Fact-Finders Cross the Bridge

We often describe trial lawyers as advocates, storytellers, strategists, and performers. But at its core, trial practice is an act of teaching. Jurors (and sometimes judges) begin a case with limited knowledge, preconceived mental models, and competing narratives. The effective trial lawyer must build a cognitive bridge to guide fact-finders safely and persuasively from where they are to where the lawyer wants them to be.

This CLE explores trial practice through the lens of learning science and cognitive psychology. Participants will examine how people process information, how prior knowledge shapes interpretation of evidence, why attention and memory are limited resources, and how structured feedback and repetition influence belief formation. The program will translate these principles into concrete courtroom strategies.
