Nuts & Bolts of Appeals in the Third Circuit

The CLE program will cover the fundamentals and rule requirements for appellate practice and litigation in the U.S Court of Appeals for the Third Circuit. Panelists will address the nuts and bolts of appeals, with helpful practice pointers, and rule references.

Panelists will provide guidance regarding how to:

  • prepare case opening documents that are capable of setting the case up for pre-briefing mediation;
  • examine necessary steps in the preparation of the joint appendix;
  • examine briefing strategies from the perspective of an appellant and an appellee;
  • examine strategies for elevating a district court brief into a quality appellate brief that is responsive to the Third Circuit’s standard for review;
  • discuss the availability of oral argument and selection of cases for oral argument;
  • discuss the calendaring of cases for disposition, including timing;
  • examine rehearing criteria post disposition.  

Panelists will also offer pointers regarding how to avoid common pitfalls in appellate advocacy before the Third Circuit.
