What Every Family Law Attorney Needs to Know About Bankruptcy Law

Financial difficulties are commonplace in divorce. It is not unusual for the financial stresses of divorce to lead to bankruptcy for one or both parties, or for insolvency and the need for bankruptcy relief to be the precursor to divorce.

This CLE will cover the role of bankruptcy proceedings in divorce and support matters. Panelists will address the role of bankruptcy in property/asset division, the treatment of spousal and child support obligations, and strategic considerations around the timing of bankruptcy and divorce filings.

Panelists will address the following topics among others:

  • The basics of bankruptcy filings
  • The complexities of the automatic stay
  • The effect of bankruptcy on a divorce generally
  • Timing issues when filing for bankruptcy and divorce
  • How to address discovery issues
  • The impact of bankruptcy on support
